Request a Hearing to Prevent Driver's License Suspension
After a DUI arrest in Utah, your driver's license will not be automatically suspended. Instead, you have 10 calendar days from the date of your arrest to formally request a driver's license hearing with the Utah Division of Motor Vehicles (DMV).
Ten Day Time Limit to Request a Driver's License Hearing: If you do not request a driver's license hearing within 10 calendar days of the date of your arrest, then your driver's license will be automatically suspended for 90 days to two years. You will have no option to request a restricted driver's license for work or child care purposes, and you will have no chance to appeal the suspension.
It can be very helpful to have assistance from an experienced DUI defense lawyer at the administrative hearing stage. Even though the driver's license hearing is not a criminal court proceeding, the hearing will give your lawyer a chance to get an early look at the state's case against you. Your attorney can use that information when preparing a defense to the criminal DUI charges.
Can a Non-Utah Driver's License Be Suspended?
Yes. If you are arrested for a DUI while driving in Utah, and if you don't request and win a driver's license hearing, then the suspension of your driver's license will be communicated to - and honored by - your home state.
