When Are Ignition Interlock Devices Used in DUI Cases?
Beginning in July 2009, all Utah drivers convicted of a DUI with a blood alcohol content of .08 percent or more will be required to install an ignition interlock device on any vehicle they drive — for a period of 18 months.
Ignition interlock devices are already required in Utah for:
- Drivers who refuse to take a chemical test for the presence of alcohol or controlled substances in the blood or urine
- Drivers convicted of two or more DUI offenses within a period of 10 years
Along with the new ignition interlock laws come a host of potential new criminal charges: for example, tampering with an ignition interlock device, failure to install an ignition interlock device, blowing into an ignition interlock device on behalf of an impaired driver.

Alcohol-Restricted Drivers? The category of alcohol-restricted driver is a separate category from ignition interlock–restricted drivers. Alcohol-restricted drivers must not drive with any alcohol in their system, although they may not be required to install an ignition interlock device.
