When a Minor Gets Arrested for Drunk Driving

DUI Defense for Underage Drivers

Drivers under 21 who are arrested for drunk driving are especially vulnerable to the negative consequences that follow from a DUI conviction.

Unlike drivers over 21, the .08 blood alcohol content threshold does not apply in underage DUI cases. For minors, driving with any amount of alcohol in the system is an offense. A minor convicted for driving under the influence will lose his or her driver's license for one year and will require an ignition interlock device for three years after that.

Did You Know? Minors who test with a blood alcohol content over .08 percent will have their driver's licenses revoked until they turn 21.
